In case of these severe USPS delays with itl. incoming mail, the tracking status is rarely updated so when the customer receives the package this is not reflected in the tracking status. In case a package disappears in transit then we of course refund but Mrs. Roberts did not want to wait and made a fraudulent claim to PayPal instead.

Ironically, Rachelle Peterson also claimed to PayPal, our payment processor, that WE made murder threats to HER but PayPal did not take her seriously. Now she ressorted to making public murder threats to US. She confirmed her identity a few hours ago in an email to us, that she indeed is behing these threats of assassination. Since they are concrete threats of murder and since they are made against a named, identified individual, we can secure a local conviction and have it enforced in the US. With regard to your point by point assessment: 3, 4 and 6 are total BS. 3 and 4 are just outright fictional, and you agree to 6 when you enter into a transaction - to an extent, you can't waive legal rights or remedies.

Sarah here. Our company retains a "house attorney" in Prague and she assured us several times that Czech court orders are enforceable in the entire Western world, including the US, and that, specifically for the US, US residents have no appeals or delays available in US courts (at least in civil cases where US law agrees with Czech law) but a Czech court order will be enforced without delay via a US bailiff, assisted by local Police, if necessary. That means we can obtain a judgment here, the US resident must represent themselves here and if they don't we win by default. And we can garnish the scammer's wages, valuables, place liens on their bank accounts - anything a Czech Court considers appropriate.

I add that the same goes in the US. If we lose a case in the US, US judgments are enforceable here. It's reciprocality by treaty.

And of course, murder threats etc. are dealt with by cooperation with our Police and the Police of the jurisdiction from which the threats were made. We would submit evidence with our Police complaint and our Police decides whether they will refer the case to local authorities. When murder threats are made in connection to how we respond to fraud, as is the case here, and when murder threats are made repeatedly over a longer period, and when there is reasonable cause for alarm, the likelihood is great that the case will be accepted and followed-up on.

You cannot bring suit against an American in Czech court for something that didn't happen in the Czech Republic, this includes retail purchases.

Your "house attorney" doesn't exist. No attorney would tell you a Czech legal order means anything outside of the Czech Republic. For one thing, you're not going to get an extradition order on a civil case. For another, a fundamental principle of law is that the plaintiff must file their suit in the court that has jurisdiction over the defendant.

Tell your "house attorney" that she's garbage. Do they just hand out legal degrees if you get two numbers in the Czech Powerball or something?

Now, allow me to address your criminal claims...

Whatever police hold jurisdiction in the United States, they're going to wad up an order from the Czech Republic and chuck it in the trash. You can't even be extradited to another state for a misdemeanor, let alone another country. You could try contacting the Department of State, but, they're not going to get involved over nonsense... but, they might take the step of preemptively banning you from the embassy in Prague.

There is no reciprocity in civil case. You either sue here, or you don't sue.

Take for example, the civil case between World Wrestling Entertainment and the World Wildlife Fund. While the case was tried in the UK, the ruling (granting the wildlife fund trademark of "WWF") only actually applied in the UK. WWE voluntarily chose to switch to the WWE brand globally - a change they were migrating to anyway. UK law can never and will never apply to American citizens or corporations - neither will Czech law. Conversely, American courts cannot issue binding rulings on things in the Czech Republic. If we could, Budweiser would have destroyed your beer industry 70 years ago.

There are many reasons for this, but chief amongst them would be lack of constitutional protections overseas, burden of travel, and the fact that Czech citizens are not "peers" of Americans, and therefore, incapable of serving on a jury in a case involving an American.

You may have some rudimentary knowledge of a little law, but you're obviously clueless as to the reality on the ground, since we paid top attorneys in Prague to present us with the details in this matter. They provided us with a list of Americans who were extradited to Czechia for various offenses (one recently died in jail here - I think he got murdered...) and they emphatically assured me that they would speedily get any Czech civil court order enforced in any US state via US authorities. And if you'd rrefuse to open your door to a US court agent, he'd come back with a locksmith and the Police. And if you'd resist your own Police, they will use force to make you comply. Your wages will be garnished and your assets confiscated to pay what you owe.

Anything that affects a Czech resident (including a Czech company) and that is a prisonable offense here (such as defamation with intent to cause financial damage, threats of murder etc.) is an offense for which the US must and will extradite their citizens and residents.

Furthermore, any civil dispute for which a Czech court issues a verdict is immediately and without possible appeal to be enforced in the US as per treaty.
