Store:Amazon
Buyer's country:United States

Details:

This buyer purchased a laptop on July 21st. The item was shipped the same day and delivered on July 28th. Upon receipt the buyer stated that the item has 128GB SSD instead of the 512GB SSD as stated in the item description. I immediately offered a return and a refund with a prepaid return shipping label. I also offered a replacement or a partial credit. The buyer settled for the partial credit and I assumed that this issue was resolved.

A week later the buyer told me that he has opened a support case with Lenovo and is asking them to fix the hard drive 'issue'. This went on for a month between the buyer and lenovo and eventually Lenovo refused to resolve this issue. Now, 6 weeks after receipt the buyer has filed an A-to-Z claim with Amazon stating that he has already returned the computer to me and is entitled to a refund. Of course, this is not true. The buyer hasn't returned anything to me and he has no proof.

Just wanted to document this to get it off my chest.

Next time dont offer anything to any buyer whatsoever. No partial refunds nothing. Refund upon receipt of return and it is fully functional. Some buyers are total assholes into seeing what they try to get away with and regardless of what you do, they still screw you in the end. The reason why you got the dispute was because Lenovo told the buyer to go F off.

Anything with a credit card, the buyer has to prove that they returned the item in its original state to get a refund. Amazon would be sued left and right if they gave a buyer a refund without the return. Amazon has to provide proof of the return to your address not anyone elses. If amazon screws sellers like you over and has no regards for your business, dont give them any.

I am the person the seller is complaining about above and I like to set the story straight. The seller advertised an Lenovo Factory Recertified Laptop with 512 GB HD. I received the laptop with 128 GB and informed the seller. The seller stated that he has no replacement laptop available with the advertised 512 GB. I called Lenovo customer support and they had ask me for the product number. Lenovo customer support conformed that the product number given shall have a 512 GB drive, and since it is under warranty I can send it to Lenovo for repair. I informed the seller about this and the seller suggested a small refund for my inconvinience of sending the laptop to Lenovo for repair. I agreed. After I shipped the laptop to Lenovo, Lenovo informed me that is was not a factory refurbished laptop and they wanted to know from whom I bought it.

I gave them the full contact from the Amazon seller. Next I waited for 1 month. No response. I contacted again Lenovo and they said that I will not receive the laptop back since it was not an original Lenovo refurbished laptop and has NO warranty! I realized that the seller must gotten the laptop from some strange market or who known from where. I informed Amazon about this and forwarded them all conversations with Lenovo. Amazon opened a case but did not refund. Next I had to ask an attorney friend for a favor, that attorney called with me Lenovo and we finally got connected to a manager at Lenovo. Finally, 5 months after my original purchase Lenovo refunded me the remainder on the spend money to the Amazon seller and I never received the laptop back.

Lenovo had no license to keep your laptop, even if it was pirated. They aren't law enforcement, they don't have the authority from a court to seize property regardless of whether it's "legal" or not. I'm not saying companies don't try this - ask those guys in the RIAA riot gear that used to raid flea markets until one of them had an involuntary head piercing and a judge told them tough shit. Nintendo has attempted this in the past, too.

But, that doesn't make it legal. When Lenovo refused to return your laptop, they committed theft - possibly grand theft depending on the value of the laptop. A criminal complaint should have been filed against Lenovo at that point - not with the police, but with the United States' attorney's office. You'd have had the laptop back in a couple of day, since no minimum wage call center dude is going to do 30 days in county to cover Lenovo's ass.
