The first thing, did you insure the item. Secondly you should be warry about selling high value items on eBay because you get into this situation. Ebay knows the empty box is a common scam and they pull these scams because they know nothing his going to happen to them and they think they are going to get away with it. Take matters into your own hands and tell the asshole your going to contact his local police department and his post office were he gets his mail deivery and file fraud charges.
