| Details: | Buyer bought a used video game console, 4 high end games and three controllers from me $140. She gets her item and says its "not as described" that the controllers "rattle" aka the rumble feature and the games were scratched. Everything was tested and working. She asks for a return and eBay forces us to accept it because she says it was not as described. She RETURNS THE WRONG ITEMS. She returned 5 completely different games, stealing my high end games and eBay sides with her saying since we accepted the return there is nothing they can do. They force the refund and she gets to keep the games and her money! Thief! |

There's everything they can do. Legally who ever processed your payment for this item is legally responsible for it. Regardless of whether you accepted the return or not you would of lost the dispute thinking she was returning the original items. You were under the impression that you were getting your orignals back. The first thing you should of done is go to your post master and tell him exactly what had happened. Document everything. Second, get a certified letter to this bitch telling her that if she doesnt return your items you are going to (1) file mail order fraud chargest against her and (2) send her to a collection agency for the amount she stole from you. She didnt return the wrong items, she ripped you off. The fact that you sit here for 2 months and do nothing is proof on how you conduct your business. Get into the world of reality, EBay doesnt make the final say in the matter, they do not want to get involved until you start taking legal action against them. They are playing the odds that your stupid. The buyer defrauded you, it was because of EBay you got defrauded, and they did nothing about it when you brought it to their attention. Hense, they legally violate their own policies. EBay and PayPal have to answer to state, federal, and credit card policies. You should of gone to PayPal and make a formal complaint that the buyer ripped you off. You still have 10 months to take legal action against this bitch.
