Please know the sequence of events:
I ordered and paid for product.
Product did not arrive, nor did confirmation of purchase, nor eta on when it would arrive.
I contacted seller by email and voicemail after waiting for three weeks for it's arrival.
He did not respond.
I contacted him through Paypal.
He responded attempting to frame me as a bad buyer, still providing no eta if ever.
I cancelled order. ****In order for a contract to be binding, both parties have to give some form of consideration.**** He did not therefore we never had a binding agreement.
Afterwards, when we had no agreement, he sends product and tracking information.
But I had already ordered from another company.
When product arrived, I returned it to him immediately. Please know that I did not legally have to return product that I did not order, but I did to be fair.
Paypal's dispute department talked to me on the phone promising me that they are giving him ten days to refund $38.26, after which time, they will rule dispute in my favor and credit me the money.

Seller's like that need an education in business and ethics before they can succeed. I wish the Seller well and hope he has the heart to take this post down and accept responsibility for his actions. Acknowledgement of wrongdoing is the first step toward a positive change. :)

I hope that you may grow your business from what I’m about to tell you. It’s from my prospective, as a buyer, why this sale failed. And then afterwards, will you please be so kind as to remove my name from the bad buyer list?

Digging back into my email I find the following:
Nov 4, 2015 07:11:24 PST - Paypal, not you, acknowledged my purchase, but if you had then too with an estimated time of arrival, I would have been more confident with our agreement.

Then for the next two weeks, I recall sending some emails to you through the Paypal site asking for an eta, however, you did not respond. If you had, I would have been more confident with our agreement.

Wed, Nov 18, 2015 at 6:04 PM - Two weeks later, after still no eta, or announcement of shipment, just before 6:04pm, (I still don’t know what part of the world you live in), I called you only to find some outdated, unprofessional phone system with no outgoing message for instructions as to working hours, best times to call, much less an actual person or even a voicemail system where I could leave a message. So then at 6:04 pm I contacted Paypal. Yes it probably was only eight minutes apart, or maybe a half hour, but my contacting Paypal, to me seemed the next logical step since I could not reach you via email or phone.

Thu, Nov 19, 2015 at 1:01 AM -- You finally respond to me through Paypal. You already had two weeks to acknowledge receipt and/or send the package. Your lack of contact and poor phone system, was like you could care less to respond or interact with a buy at all unless I involved Paypal. This 11/19/15 contact was the FIRST contact I received from you acknowledging even that I had paid for the $38 product. But even though you responded to me, you still never even promised me when you'd send it, if ever. What’s worse is that my first contact from you, you falsely accused me of being a bad buyer. With all due respect, people can't work like that, ma-am, which is why I had no choice but to cancel the order.

Even though I had to contact Paypal, you could have salvaged the deal still, but your attitude was hostile towards me from the start. You could have been apologetic towards me and provide an estimated shipping date. But instead, you falsely accused me of being a bad buyer. I wish I had saved your response, but Paypal erases them after six months.

I have bought literally thousands of dollars of items online without problems.

You are, or have been a bad seller. But it doesn't have to stay that way if you can:
1. When you get an order, immediately send an acknowledgement of receipt of payment and give an eta for its arrival.
2. Promptly mail the item and then provide tracking information.

Finally, I shouldn't have had to ask Paypal to intervene to get you to perform. Open the lines of communication using chat, phone and email. Always be polite and courteous. When you get an order, fill it ASAP. Your life may have been too hectic to perform timely, but if that’s the case, then maybe you shouldn’t offer items for sale until you can perform.

Prove that you didnt call after hours and then 1/2 hour later you placed a fraud dispute claiming non receipt of merchandise. Then prove that you didnt file another dispute the second you got the package claiming not as describe merchandise received. The fact is you had every single opportunity to contact the seller but you decided to place 2 fraud disputes. There is documented evidence of you stating numerous times you agreed to the terms and conditions of the sale. Everything that is stated is exactly what you did. Tracking number shows you "refused" the package, which means either you deliberately commit fraud on the "not as described dispute" meaning you never had the package in your possession, or you defrauded the USPS postal service in not paying for the return shipping for the item, you claimed that was "not as described". Either way the sellers terms were clearly stated and it stated if you didnt agree with the terms, to purchase the item elsewhere. In addition, prior to any checkout or payment being accepted you stated numerous times you read and agreed to the terms. The seller provided you numerous methods to contact them, but instead you took it upon yourself to file fraudulent dispute after fraudulent dispute. As far as your "non receipt of merchandise" you have to prove the item was received after the established mail order shipment rules which you never did. The terms clearly stated the company's shipment time frame, you knew about this prior t the purpose, legally stated you read and agreed to it prior to any payment being accepted, and you deliberately violated these terms by filing ficticious dispute after ficticious dispute. The buyer made a false telephone call when she knew outright it stated to use a specified method of contacting company. She did that only to make an excuse that she "tried to contact the seller" knowing full well it was way after business hours, the immediately filed a fraud dispute for non receipt lost that dispute and then filed another fraud dispute for not as describe. The tracking shows she refused the package, which means, either she filed yet another fraud dispute, or if she never had the package in her possession, defrauded the US Postal service in purposely not paying for the return shipping.

You want this removed, go to the website provider and ask them to remove it, the information is stored on their server!

Correction. Instead of non receipt of merchandise. This theif filed a fraud dispute claiming she never authorized the transaction. She lost the case, then filed another dispute claiming the product was not as described. So thats 3 counts of fraud. First saying she never authorized the transaction then saying the product was not as described then openly admitting she made the purchase and going into her BS interpretation. So either way its proven attempted mail order fraud.

*****Please understand, that as a buyer, I have no idea what time zone you are in, so I have no idea when is a good time to call you. If this is a problem for a seller, then the seller should have a voicemail system that states hours and time zone.

*****All I thought I did with Paypal is to have them deliver a message to you because my emails to you were unanswered. I did not intend to mark you record. After two weeks of patiently waiting, I just wanted communication. If I had to click the button for a dispute it's because there were no other options for me to get through to you. I'm sorry for that, and maybe Paypal can revisit the details of this transaction to see if they have any other better way to open up the lines of dialogue.

*****The reason why I refused the package is because when I couldn't get an eta from you, and when instead I got accused of being a bad buyer, I had to get one elsewhere. The product was for my mom who needed a keyboard. She's disabled and spends most of her time alone in her apartment. I had to get her a keyboard.

*****Here's a little secret you can keep with you. There's a book called, "I'm ok; You're ok." Mostly people like to think they're ok. But when people around them accuse them of being not ok, they seek to get away from that person. In my circumstance, when you accused me of being a bad buyer, I just wanted to run from you. It's funny because I think in hindsight, your accusation of me, is what made me, in your eyes, be a bad buyer. So I guess what I'm saying here is that if you don't want people to be a "bad buyer", you shouldn't accuse them of such. Does that make sense?

I can see here that you are teachable, and have seen improvement with even just our correspondence. Lets get this thief done and over with. THIS BUYER DELIBERATELY COMMITTED MAIL ORDER FRAUD 3 COUNTS! (1) Shoots herself in the foot when she mysterious knows exactly what happens when a person files a dispute claiming Not Authorized. (2) She contacts our company then 15 minutes later files a fraud dispute (because she knows she had to make an attempt to contact the seller in order to satisfy the chargeback requirements) (3) knows full well she gets to keep the item if she didnt order it (so this is premediative her intentions were already set to defraud our company even prior to the purchase) (4) we submit 25 pages of documentation linking every single piece of information to her proving deliberately mail order fraud including linking the actual computer and IP address of the internet connection she used to make the purchase (5) she looses the dispute, then files another chargeback for non receipt of merchandise in another attempt to commit fraud. (6) people who file disputes claiming they never made the purchase DO NOT SUBMIT ADDITIONAL CHARGEBACKS CLAIMING THE PRODUCT THEY RECEIVED IS NOT AS DESCRIBED! (7) the credit card company knows full well she's committing fraud so she looses the 2nd fraud dispute! (8) she is caught lying once again in her own words, either you defraud the USPS postal service into not paying for return shipping because the tracking number shows you had full possession of the item or you get caught once again, falsifying a dispute for not as described, which means if you opened the package you saw what was inside the box to say it wasnt as advertised and once you open the item you are legally responsible paying for shipping. This thief goes from deliberately falsifying a dispute for non receipt of merchandise on november 4, 2015, saying she called when the entire length of the phone call was 3 seconds to start her fraud to complete her credit card fraud chargeback. Then files another dispute after she looses the 1st dispute for not authorized merchandise on December 01, 2015, proving she's nothing but a 2 bit liar trying to steal merchandise. This bitch looses the 2nd dispute. At point the credit card company is already onto her fraud attempts to steal the product.
